PICHAY READY TO RELEASE GM SO BUT…

In an obvious change of heart, the National Chess Federation of the Philippines (NCFP) is now willing to give GM Wesley So the go-signal to transfer to the United States Chess Federation (USCF).
This was confirmed by So himself following a 30-minute long conversation with NCFP president Prospero “Butch” Pichay during which he wished the 20-year-old Filipino champion well.
“I just had a very good conversation with Mr. Pichay and the situation regarding my transfer request is encouraging,” said So during an interview with Chessdom.
“He (Pichay) said that he is not upset with me at all, and he only wishes the best for my chess career. He has no objection with me transferring federation to the US,”added So, who is scheduled to leave Missouri, USA on Thursday to compete in the ACP Golden Classic in Bergamo, Italy.
There’s still one hitch, however.
Pichay told So that “he is not in the position to sign the consent for the release without the approval from the PSC (Philippines Sports Commission).”
“The PSC is the organization which funds the NCFP and they have the overall final authority. My understanding is if the PSC consents, Pichay will also consent and it will be final. So it is now up to the PSC to decide. The ball is on their court and the clock is ticking,” explained So.
The second year business and finance student of Webster University expressed confidence that the PSC, headed by Chairman Richie Garcia, will pose no objection.
“They have nothing to gain by not signing the consent form. They also cannot stop me from making the transfer. The only thing they can do is make me wait for approximately another full year. This would certainly harm my chess development because I have to sit out on all official FIDE tournaments, including the world championship cycle, and various important invitations,” explained So.
Pichay’s assurance to So is expected to finally pave the way for a smooth transfer to the USCF.
Close friends-supporters of So said Ramirez and the PSC will certainly not stand in the way of the Filipino player’s development, especially since the transfer to the USCF is expected to help push his career forward.
“In fact, Garcia and the PSC appears to be very supportive to So when he brought home the gold medal in the 27th Summer Universiade in Kazan, Russia last year. The PSC had no objection in releasing the cash incentive to So if there was an endorsement letter from the NCFP,” said the source.
The refusal of the Phlippine Olympic Committee (POC) and the NCFP to recognize So’s gold-medal achievement was one of the reasons given for So’s decision to switch federations.

The standard procedure is when a player request for something their respective National Sports Associations (NSA), its the NSA that will decide on the request thru Board Resolution, w/ all their signatures and the justification/merits of the request together with the decision of the NSA whether they will grant or not with the request. If the decision is favorable to the player, the NSA Board Resolution favoring the players request will then be forwarded to the Philippine Sports Commission (PSC) whose role is simply ministerial. If the NSA will agree, the PSC will just confirm thru a resolution nothing more. This is because the NSA is the proper party to decide whether to grant or not the request and NOT the PSC. Only if the NSA decision is adverse where the player can appeal his case to PSC, if still adverse to the Philippine Olympic Committe, still adverse to the Office of the President & if still adverse to the Supreme Court via the remedy of certiorai under Rule 65 of the Rules of Court. This is following the doctrine of exhaustion of adnnistrative remedies where you start from the bottom then go up. So that the NCFP as the NSA for chess, should decide first if request by players made before them then the PSC ministerial duty to just confirm it eapecially true if the NCFP decision is favorable to the requestor. In laymans term, NCFP pointing to PSC as the decider whether to grant or not grant consent to GM Wesley So is PLAIN BULLSHIT.
In one interview PSC Chair stated on record that if NCFP will grant consent to transfer of GM Wesley So to USCF, they will just confirm and give their OK and they will not object nor stand in the way if it is for the best interest of GM Wesley So. Now why on earth NCFP President Prospero Pichay pointing to the Philippine Sports Commission as the one who ultimate has the final say whether to grant or not grabt GM So request? Under the rules & procedures, the NCFP as the National Sports Association for Chess in the Philippines has the authority to decide on matters pending before the like a player request for transfer etc because as a chess body sanctioned by the PSC they are in better position to determine, based on facts presented to them, whether to grant the request of GM Wesley So to transfer or not. The PSC is merely supervisory and whose role is ministerial as far as the matter of players request, they DO NOT decide whether to grant or not the request as they only base on whatever recomme dation made by the NCFP. In the same way as the request for incentive of chess players winning international competitions. PSC Chair even went on record and said it has no objection on granting the incentive to GM Wesley So for winning the Gold last 2013 in the 27th Summer Universiade in Russia if only the NCFP had made the necessary papers Re: NCFP Board Resolution recognizing the Gold Medal feat of GM Wesley So in the 27 Summer Universiade in Russia last year and recommending that he is entitled to the incentive and recommend to PSC for giving GM So said incentive. In the same manner as granting a Php 40,000 per month priority atlhlete allowance the decision whether to grant or not rest on the NCFP NOT the PSC. An NCFP Board Resolution recommending a chess player for the priority athlete status thus entitled to a Php 40,000 per month allowance. This resolution will be forwarded to PSC for conforme and setting aside the budget for the NCFP request. It is always the NCFP that makes the first decision then the matter is elevated to the PSC. It is never the other way around. Now here you come NCFP Pres Pichay pointing to PSC as the ultimate decide whether to grant or not the request of GM So. Pichay in effect is NOT keen on granting GM So consent to transfer and with all the pointing fingers, after the dust has clear GM Wesley So had already sat 1 year waiting for the consent that was not forthcoming from the very start. NCFP Pichay is a GENIUS EVIL after all lol
