In view of some recent events in the cheating controversy and several hasty comments from the press, the ACP Board has decided to clarify its position on the matter.
The ACP Board does not believe to have the power to establish a verdict based on the available evidences on whether certain players made use of illegal means to improve their playing strength and results. We find it wiser, however, to concentrate our energy on trying to find solutions to the problem of cheating in general.
The situation has become unpleasant, to say the least. Rumours can be very harmful. Recent allegations and articles published in the press create an unhealthy situation in the chess world. We are afraid that a tense atmosphere of reciprocal suspicion among chess players may install itself at future top-tournaments.
We consider it our duty to make everything possible to prevent such a scenario to happen. It would be wrong, however, to pretend that cheating in chess cannot exist, or that no one would ever cheat. Bearing in mind that progress in technology and electronics undoubtedly create more and more cheating opportunities, the problem is real. In our view, the solution involves creating tournament conditions which will not allow cheating altogether. Some important measures have to be taken. It seems obvious, however, that all steps will not be applicable to all kinds of tournaments. The more participants, the more difficult the chance to create perfect conditions.
The ACP Board has written a letter to FIDE in which a set of concrete measures have been proposed to prevent cheating opportunities. A similar letter will also be sent to organizers of the most famous tournaments.
Thus, we hope that temptation will no longer be possible, and that rumours will consequently disappear. The integrity of our chess elite is at stake. We expect a fruitful discussion to lead to important decisions in this matter.

PERFECT !!! They are not going to rule on catching people red handed with wires in their restrooms but will instead work on encouraging the building of restrooms without wires in the future.

LOL. Not sure you know what the phrase “red-handed” means in English. It means “caught with proof on you”. It doesn’t mean “it’s perfectly innocent to find wiring in the ceiling, but if this wire went to a Fritz, and if Kramnik had a ladder with him to get at it, and if he had a handheld device that the metal detectors missed, he might have used this to cheat.” That’s not what red-handed means.
But have it your way. If the wire is proof, then congratulations, you’ve just nailed Topalov. They alternated restrooms before Game 5, meaning that room was Topalov’s half the time. So Topalov got caught red-handed (your words) at Elista, just as he got caught red-handed (my words) at Corus and San Luis.

The ceiling was over 10 feet above the floor. Impossible to reach the ceiling without a ladder.
OF course the ladder was not in the bathroom when they played chess. The workmen needed the ladder to open the ceiling since it was impossible to reach the ceiling without a very tall ladder.
most ladders are 6 ft tall. this ladder was 10 foot tall. Most rooms are 7 1/2 foot to the ceiling.
Even old Victorian homes do not have 10 foot ceilings.
For Topalov to have used the cable in the ceiling he would have had to levitate off the ground about 4 feet. Even I dont think Topalov could have done it.

So Kramnik is supposed to be photographed standing on a ladder in the restroom with a computer running Fritz connected to the wiring and a holding a large sign saying “I’m Cheating” ?!?!?!?
If this is your idea of “red handed”… everyone could start cheating now cos it will never be proved.

Even if Kramnik was consulting Fritz in the restroom it does not mean he cheated! He might not have used the moves fritz suggested. To prove cheating you must prove that Kramnik used the moves that Fritz suggested directly and that is difficult to do!

Of course we know he wasn’t, since he was searched and didn’t have one, but if he were a psychic and had the power to make objects materialize out of thin air, and if he could fly up to the ceiling to plug it in, then he might have done something with it.
Either way, it’s a lot better evidence than anything against Topalov. How do we know that what Danailov was signalling was chess moves? He could just have been telling Topa that his fly was unzipped.
